TrackLab (Los Angeles Lab Inc.) Terms of Service

Welcome to TrackLab. These Terms of Service (“Terms”) govern your access to and use of the products and services offered by Los Angeles Lab Inc. (“Company”, “TrackLab”, “we”, “us”, or “our”), including GPS tracking devices, IoT data plans, and fleet monitoring software. By purchasing, accessing, or using our products and services, you agree to comply with and be bound by these Terms.

Acceptance of Terms

By using our products and services, you agree to these Terms, our Privacy Policy, and any additional terms, policies, or guidelines we provide. If you do not agree to these Terms, you may not access or use our services.

Products and Services

Products:

  • We sell GPS tracking devices globally. These devices are manufactured in China to our specifications and certified by FCC and CE.
  • Installation services are NOT included with the devices. The user is responsible for installation through a professional service. In certain regions, TrackLab may refer to parthers automotive engineers and services for professional installation.

Services:

  • We provide IoT data plans included with the purchase of devices and access to fleet monitoring software.
  • After the first year, an annual subscriptions is required for continued service. The subscription pricing may vary depending on the area of usage, amount of transferred data, and included features.

Refund & Return Policy

Non-Returnable Devices: Devices are not eligible for return or refund once ordered.

Warranty Replacement: Devices with malfunctions caused by assembly defects or broken parts may be eligible for replacement. However, damage from shipping, installation, or improper usage will not qualify.

Subscription Services: A paid subscription is required for continued data and monitoring after the first year, which is included with the device.

Cancellation of Subscription: If canceled, devices will be removed from the software, and IoT SIM cards deactivated. Hardware remains with the customer. Customer data is retained for 3 (three) months after subscription cancellation.

Non-Refundable Data Plan: The data plan is non-refundable and not covered by warranty.

Privacy and Data Protection

We comply with data protection regulations, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

GDPR Compliance:
For customers in the European Union, we handle personal data in accordance with GDPR. You have the right to access, rectify, or delete your data, and to object to or restrict its processing.

CCPA Compliance:
California residents have specific rights regarding their personal information, including the right to know what personal information is being collected, and to request the deletion of their data.

User Responsibilities

You are responsible for:

  • Ensuring that the use of our GPS tracking devices complies with all applicable laws and regulations, including those concerning privacy and vehicle tracking.
  • Correct installation of the devices by a professional.
  • Maintaining your fleet monitoring software account and ensuring your credentials are secure.
  • We provide detailed instructions for setting up the devices; however, any damage resulting from improper installation or misuse of the devices is not covered by us.

Disclaimers and Limitations of Liability

Accuracy of Data:

While we strive for the utmost accuracy, GPS data may be affected by factors such as signal obstructions, environmental conditions, or technical malfunctions. We do not guarantee 100% uptime or precision.

Product Warranty:

Our devices come with one year warranty since the moment of purchase against manufacturing defects.
Damage caused by improper installation or external factors is not covered by the warranty.

Service Availability:

We do not guarantee uninterrupted access to the fleet monitoring software or data plans. Maintenance, upgrades, or unforeseen events may result in temporary service disruptions.

Liability Limitation:

To the maximum extent permitted by law, Los Angeles Lab Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the products or services, including, but not limited to, vehicle damage, business interruption, or legal violations related to misuse of the GPS tracking system.

Intellectual Property

All intellectual property rights, including trademarks, logos, and service marks displayed on our website, products, and services, are the property of Los Angeles Lab Inc. or its licensors. You may not use, copy, or reproduce any of these materials without prior written consent.

Modifications to the Terms

We may revise these Terms from time to time. The updated Terms will be posted on our website, and the “Effective Date” at the top will be revised accordingly. Continued use of our products or services after such updates constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal disputes arising under these Terms shall be resolved in the state or federal courts located in Irvine, California.
